NDIS Code of Conduct

The NDIS Code of Conduct promotes the safe and ethical delivery of services.

The NDIS Code of Conduct is essential for ensuring that all NDIS providers and their staff meet their responsibilities to clients.

It makes no difference whether your business is NDIS-registered or not. If you provide products or services to an NDIS participant, you must follow the code of conduct.

NDIS Code of Conduct Applies to

  • It will apply to NDIS providers who are registered.
  • It will apply to unregistered NDIS providers.
  • This is valid for the provider who offers specialised services such as capacity-building.
  • Providers who offer service to aged people (over 65 age).
  • NDIS Commission employees.
  • Coordinators for Local Areas.

All people with disabilities have full and equal human rights to make their own decisions, live as they choose, and receive the assistance they require.

People with disabilities can question, request additional information, and decline any aspect of their service delivery.

2. Respect the privacy of people with disability

People with disabilities have the right to privacy, including collecting, using, and disclosing information about them, their health, or their disability.

Provide Support And Services Safely And Competently, With Care And Skill.

Providers must only engage with you if they have the necessary expertise to complete the job correctly and safely. Providers must have and keep the necessary qualifications and skills.

Providers must be open with you about the cost and expected outcomes of the assistance they will give.

Providers must tell you if they profit financially from the advice they give you, and they must be open and honest about any conflicts of interest.

5. Promptly take steps to raise and act on concerns about matters that may impact the quality and safety of supports and services provided to people with disability.

If the safety or quality of support for individuals with disabilities is compromised, you must respond quickly to address the fundamental reasons.

Establish the individual’s safety and discuss how they would like to settle the situation and take action.

6. Take all reasonable steps to prevent and respond to all forms of violence against and exploitation, neglect and abuse of people with disability. 5. Promptly take steps to raise and act on concerns about matters that may impact the quality and safety of supports and services provided to people with disability.

We all have a responsibility, particularly as providers, to help prevent the mistreatment of people with disabilities.

This includes responding to and reporting any violence, abuse, neglect, or exploitation of individuals with disabilities to the NDIS Commission and, if necessary, other authorities.

7. Take all reasonable steps to prevent and respond to sexual misconduct.

When delivering services and assistance, providers and workers must maintain the highest ethical standards, be respectful, and protect the safety of individuals with disabilities.

What if someone violates the Code of Conduct?

All suppliers must ensure that their employees follow the code, and there are serious penalties if they do not.

The NDIS Commission has the authority to conduct investigations of registered and unregistered providers and staff.

If the violation is minor, the Commission may issue a warning or require more training for those involved.

It would help if you were informed that certain violations might result in punishment, including termination from your job.

The NDIS provider can be banned from involvement in the sector by being de-registered or even by civil penalties pursued in court.
